Workman's Compensation

Adjudication

A judicial dispute resolution process in which an appeals board makes a final determination.

Arbitration

A dispute-resolution process in which a final determination is made by an impartial person who may not have judicial powers.

Coal Mine Workers’ Compensation Program

Provides compensation and medical coverage to coal miners who are totally disabled by pneumoconiosis (black lung disease) arising out of coal mine employment, and to survivors of coal miners whose deaths are attributable to the disease.

Employees’ Compensation Appeals Board (ECAB)

Hears and decides cases on appeal from decisions of the Office of Workers’ Compensation Programs (OWCP) in an impartial and expeditious manner.

Energy Employees Occupational Illness Compensation Program (EEOICP)

Provides compensation and medical benefits to eligible employees and former employees of the Department of Energy, its contractors and subcontractors, or to certain survivors of qualified workers.

Black Lung Program

Provides compensation and medical coverage to coal miners who are totally disabled by pneumoconiosis (black lung disease) arising out of coal mine employment, and to survivors of coal miners whose deaths are attributable to the disease.

First Report of Injury

Workers’ compensation form completed when the patient first seeks treatment for a work-related illness or injury.

Longshore and Harbor Workers’ Compensation Program (LHWCA)

Provides compensation, medical care, and vocational rehabilitation services to employees disabled from on-the-job injuries occurring on navigable waters of the United States, or in adjoining areas customarily used in the loading, unloading, repairing, or building of a vessel.

Federal Employees’ Compensation Act (FECA) Program

Provides compensation benefits to civilian employees of the United States due to personal injury or disease sustained while in the performance of duties; also provides for payment of benefits to dependents if a work-related injury or disease causes an employee's death.

Mine Safety and Health Administration (MSHA)

Carries out provisions of the Federal Mine Safety and Health Act of 1977 and works cooperatively with various agencies to improve safety and health conditions for miners.

Occupational Safety and Health Administration (OSHA)

Ensures safe and healthful working conditions for workers by establishing and enforcing standards.

State Insurance Fund

A quasi-public agency that provides workers’ compensation insurance coverage to private and public employers and acts as an agent in workers’ compensation cases involving state employees.

Office of Workers’ Compensation Programs (OWCP)

Administers programs that provide wage replacement benefits, medical treatment, vocational rehabilitation, and other benefits to federal workers or eligible dependents.

Permanent Disability

Refers to an ill or injured employee’s diminished capacity to return to work.

Survivor Benefits

Claim that provides death benefits to eligible dependents, which are calculated according to the employee’s earning capacity at the time of illness or injury.

Vocational Rehabilitation

Claim that covers expenses for vocational retraining for both temporary and permanent disability cases.

Temporary Disability

Claim that covers health care treatment for illness and injuries, as well as payment for lost wages.

Workers' Compensation Board

State agency responsible for administering workers’ compensation laws and handling appeals for denied claims or cases.
