Madison Vs Marbury

  • Judiciary Act of 1801 - president has more control over appointment of judges

  • Adams appointed many federalists to become judges in federal courts (midnight judges)

  • Jefferson ordered secretary of state James Madison to deny judge appointments

  • One of Adam’s potential judges was Marbury, and sued Madison when Madison denied his position as a judge.

Jefferson ideology vs what he did

  • Nothing stated in constitution that Jefferson could buy land, but loosely interpreted the right to form a treaty and the elastic clause to buy Louisiana

  • Wanted a small weak central government, and less army, but had to increase the size of government and military to enforce the law

  • Despite his belief in protecting liberty, Jefferson did not grant foreigners citizenship

  • Motivations: worried about French control of New Orleans and Mississippi River, To go to the pacific ocean, more land, more resources, to establish an economy based on agricultural farming

  • Treatment of natives: poor, overpowered them, forced them to comply
