Responsible Charge

Control over and detailed professional knowledge of the development and execution of the project, including technical submittals

AIA B101

The contract in which an architect can fill in appropriate limits for the project

A201

Terms and conditions of the relationship between client and architect

Occurrence Based Insurance

Only covers acts that occur while the policy is in place

Claims Made Insurance

Will cover any claim made in the coverage period, even if insurance wasn’t in place when the error occurred

Waiver of Subrogation

Between architect, client, contractor, agreement that each party’s insurer will not pursue subrogation

Subrogation

When insurance company pays out a claim and then pursues claims against other parties who they believe caused the damage

Tail Coverage

Extends coverage if you retire and don’t want to pay anymore

Statute of Limitations

Timeframe that begins at the discovery of an error (You discover an error and have 2 years to file a claim)

Statute of Repose

Timeframe that begins when the error is committed (A claim can only be filed within 10 years of project completion)

Competence

Model Rule #1, an architects primary duty to protect health, safety, and welfare of the public

Conflicts of Interest

Model Rule #2, an architect cannot receive compensation for a project twice, you cannot accept a bribe to include a specification in a project.
