Entick v Carrington
Judges rejected the claim that a Minister’s warrant alone could justify searching premises and seizing papers for alleged sedition. Dismissing the government’s “reasons of state” argument, the court stated, “the common law does not understand that kind of reasoning.” They made clear that official status doesn’t automatically give legal authority: “If it is law, it will be found in our books. If it is not found there, it is not law.”
