Private law
Law that deals with cases regarding individuals, businesses or organisations. These include tort law, contract law and property cases.
Public law
Deals with cases regarding the government and citizens. This includes constitutional law, administrative and criminal law.
Criminal Court Procedure
Between a prosecutor and defendant
The state brings the case to court
The onus (burden of proof) is on the prosecutor to prove
The standard of proof is ‘beyond reasonable doubt’
Civil case Procedure
Between individuals
A plantiff and defendant
An individual or organisation can bring the case to court
The onus is on the plantiff to prove the case
The standard of proof is one the ‘balance of probability’
Parties can solve disputes and avoid going to court
The use of jury is optional
Tort law
Civil wrongs where someone is wronged (nuisence, negligence or defamation)
Sources of law
Statue law- Made from Parliament and go through a process (high court and low court)
Common law- made from England/ judges and apply to everyone
