cannot be charged with choate and inchoate offense

some substantial step is required in completing the crime, not penalizing evil thoughts
#1 attempt
specific intent: must act purposefully, cannot be done recklessly
overt act toward commission: must be a substantial step towards completion
failure to consummate the crime: why did it fail?

#2 conspiracy
“agreement”, favorite tool of prosecutors, use it as a vice
actus reas: proof of an agreement necessary, although some states require overt act in futherance of criminal goal
mens rea: specific intent to attain a particular criminal objective on the part of at least one person in the partnership, specific intent to agree, more likely with two or more people
unilateral vs. bilateral
unilateral: in a group of conspirators, there is at least one individual with criminal intent
bilateral: at least two guilty persons are required
chain conspriracy
each person in the conspiracy handles the commodity at different points in the process, linear connection,

wheel conspiracy
hardcore group of participants handle most of the transactions and there are spokes (hub and spokes)
if there is a common purpose: 1 conspiracy

issues of conspiracy
close proximity to punishing “evil thoughts”
longer the conspiracy lasts, more critical it is, greater chance of successful prosecution

a conspirator is held liable if:
crime that is the object of the conspiracy
any other forseeable crimes commited by their co-conspirators in furtherance of the conspiracy

reunuciation: “abandonment” requires the actor to “:thawrt the success of the conspiracy
withdrawl: similar to abandonment but not the same, not required too seek to defeat the conspiracy

one person requests or encourages another to perform a criminal act, under common law, can be tricky because of free speech rights
mens rea: specific intent to encourage another to commit a crime
actus reas: words that contain some inducement
