Dred Scott lived with his owner in Illinois and Wisconsin, where slavery was illegal. When they moved to Missouri, he sued saying he was a free man because he previously lived where slavery was illegal.

They did not grant Scott freedom. They said Congress had no right to prohibit slavery anywhere because it’s unconstitutional.
