1st Degree Forgery

With intent to defraud, person falsely makes, alters, utters a written instrument that they try to make seem genuine/real

2nd Degree Forgery

Same as 1st degree but just with something other than what is one the list of items in statute

Criminal Possession of a forged instrument

Having something knowingly fraudulent but has not used it yet

2nd Degree possession of forged instrument

Same as 1st degree just with something not specifically listed

Merger of Offenses

You cannot charge someone with forgery AND possession of forged instrument
