Murder
The unlawful killing of a reasonable person in being under the kings peace with malice aforethought, expressed or implied.
Loss of control
S54 of the coroners and justice act test for loss of control:
D must have lost self control
There must be a qualifying trigger
A person of the same sex and age would act the same
Diminished responsibility
A person who kills or is a party to a killing of another is not to be convicted of a murder if he was suffering from an abnormality of mental functioning which arose from a recognised medical condition which substantially impaired Ds ability to understand the nature of his conduct, form rational judgements or exercise self control.
Theft
Dishonestly appropriating property belonging to another with the intention of permanently depriving the other of it
Robbery
A person is guilty of robbery if he steals and immediately before or at the time of doing so, and in order to do so, he uses force on any person, or puts or seeks to put a person in fear and there subjected to force.
Battery
Infliction of the unlawful force against another with the intention or recklessness as to the infliction of force. S39 of CJA
Assault
An act causing the infliction to apprehend the infliction of immediate unlawful force on their person committed with intention or recklessness as to causing such apprehension.
ABH
Includes any hurt or injury calculated to interfere with the health or comfort of the victim. Doesn’t have to be permanent but must be more than merely transient or trifling. S47 of OAPA
GBH s20
Whosoever shall unlawfully and maliciously wound or inflict GBH upon any person, either with or without any weapon or instrument. Shall be guilty of misdemeanour, and being convicted therefore shall be liable.
GBH s18
Unlawfully and maliciously wound or cause any GBH to any person, with intent, to do some GBH to any person or with intent to resist arrest. S18 of OAPA
