DAVENPORT: Your honor, we will accept this man as a member of the jury.
One moment Mr. Bannister you’re not excused.
DRUMMOND: well hold your horses, banister you may get it yet.
mr. Drummond, you may examine the venirmen
DRUMMOND: Well, you are fortunate. He’ll do.
Take your seat Mr. Bannister. Mr. Meeker will you call a venireman to fill the twelfth and last seat on the jury?
Brady: your honor before we continue, will the court entertain a motion on the matter of procedure?
Will the learned prosecutor state the motion?
Brady: I do not feel that the dignity of the court will suffer if we remove a few superfluous outer garments.
Does the defense object to Colonel Brady’s motion?
Drummond: I don’t know if the dignity of the court can be of help with these galluses. I’ve got on.

drummond: the use of this title prejudices the case of my client it calls up a picture of the prosecution, a stride, a white horse ablaze in the uniform of a militia colonel with all the forces of right and righteousness, Marshall behind him

Gentlemen, if you please, you are both out of order the court rules that the jury has been selected. Owing to the lateness of the hour in the unusual heat the court will be recessed until 10 o’clock tomorrow morning. (
oh the Reverend Brown has asked me to announce that there will be a prayer meeting tonight on the courthouse lawn to pray for justice and guidance. all are invited.
DRUMOOND: your honor, I object to this commercial announcement.
