Joint and Individual Liability
All Tenants are jointly and individually liable for all obligations and sums due under the Lease. A violation by one Tenant is deemed a violation of all. Notice to any adult Tenant is notice to all Tenants.
Misrepresentation
If any information provided by the Tenant in the application for this lease is found to be knowingly incorrect, untruthful and/or misleading, Tenant shall be in default of this lease.
Holding Over
If Tenants continue to hold possession with the consent of the Landlord after expiration of the term of this Lease, then such holding over shall not be deemed a renewal of the Lease for the whole term, but Tenants shall be deemed to be Tenants from month-to-month only
New Home Orientation
The Tenant agrees to attend a New Home Orientation on or shortly after the lease start date if requested and coordinated by the Landlord to review the systems of the home, the maintenance request protocol, preferred property communications, the setting of door codes to the property and/or access to common areas.
Late Fees
Rent is deemed late if not received by 11:59 pm on the 5th day of the month, resulting in a late fee. An additional fee is added if rent is unpaid by the 16th.
Non-Sufficient Funds Fee
A charge applied for every dishonored payment, returned check, or rejected electronic payment, including fees charged by the financial institution and applicable late fees.
Lease Violation Fee
The Landlord reserves the right to impose a fee if any rules, regulations, or policies within the lease agreement are ignored, violated, or not upheld due to the Tenant's actions.
Electronic Payments Required
All parties acknowledge and agree that the only accepted form of payment for this property is via electronic method. Unless otherwise agreed to in writing by the Landlord, cash, checks, or money orders will not be accepted.
Order in Which Funds are Applied
Payments from Tenant received by Landlord when there are arrearages will be credited first to any outstanding balance, and then applied to any current amount due.
Non-Refundable Fee
Tenant will pay a NON-REFUNDABLE fee due immediately upon signing this lease agreement in order for the lease to take effect with the herein stated lease terms. This fee will secure the property for move in for up to but not to exceed 60 days from lease execution
Utilities
Tenant shall pay all utilities, sewer and trash service including connection fees and deposits for the premises when due, except as listed in the lease agreement.
Minimum Heat Requirement
HEAT MUST BE MAINTAINED AT A MINIMUM OF 60 DEGREES AT ALL TIMES IN WINTER MONTHS. IF THE WATER PIPES FREEZE AND/OR BREAK DUE TO THE HEAT BEING BELOW 60 DEGREES OR DUE TO DISCONNECTION OF UTILITES DUE TO THE TENANTS NEGLIGENCE THEN REPAIRS WILL BE MADE AT THE TENANT’S EXPENSE.
Trash Receptacles and Procedure
One trash can receptacle is provided per unit at the time of move-in. The trash can receptacle remains property of the Landlord and must remain at the home at the end of the lease agreement.
Utilities at Move Out
The Tenant agrees to maintain all utilities in their name and keep them active at the property for a minimum of one (1) day past the lease expiration date.
Insurance
The Landlord does not maintain insurance to cover your personal belongings or personal injury. You assume all liability for personal injury, property damage or loss, and insurable risk.
Keys and Locks
This property operates on a keyless entry system and Tenants will set a confidential, unique door code at their move in walk through
Premises
The term “Premises” shall refer to the specific address, including all rooms, living areas, attached structures (e.g. balconies, patios), as well as any Common Areas such as fitness center, dog park, etc.
Occupancy Changes
Any change in occupancy requested by the Tenant(s) will require a written request from all leaseholders submitted to the Landlord. Any changes to the parties on the lease agreement are subject to the Landlord's written approval and must be documented in an addendum to this lease
Contact and Communication
All communication between the Tenant and the Landlord must be in writing upon signing this lease agreement via the ResidentPortal app or email.
Security System/Video & Recording Devices
Hardwired security systems are prohibited. However, the Tenant is permitted to place recording cameras or video devices on the premises if they are not permanently affixed.
Common Areas
Tenant shall have the right to use parking areas, driveways, entrances, exits, sidewalks and other areas designated by LANDLORD for the common use of all and LANDLORD shall have the right to establish, modify and enforce reasonable rules concerning the use of Common Areas and
Parking
Street parking is not permitted and vehicles parked on the street will be subject to tow at the vehicle owners expense. Boats, trailers, and recreational vehicles are not permitted to be stored or parked on premises for longer than 24 hours.
Pets
No Pets (including mammals, reptiles, birds, fish, and insects) are allowed on the premises (either inside or outside of the property) unless specified in writing and attached to this lease’s pet addendum.
Condition of Premises
Tenant agrees that (s)he has inspected the premises prior to the execution of this lease and finds the same to be in good order, condition and repair except as may be otherwise noted in writing between the parties within seven (7) days of Tenant taking occupancy.
No Smoking Policy
This lease prohibits all forms of smoking or vaping, even smoking or vaping for medical reasons. Smoking of all kinds of substances are prohibited.
Alterations
Tenant shall not make alterations or additions to the premises during the terms of this Lease without the prior written consent of Landlord.
Requests, Repairs, Malfunctions, Emergency Maintenance
LANDLORD shall be responsible for all maintenance and repair of the roof and exterior walls, outside water and sewer lines, and other structural parts of the Property and Common Areas, and repair and replacement of the furnace, air conditioning system, water heater and other major appliances furnished by LANDLORD.
Right of Entry and Inspections
Landlord and/or his agents, have the right to enter the premises at all reasonable hours upon notice via email, text, posting or other form of written notice, for the purpose of inspection, responding to your request, making repairs and/or preventative and routine maintenance, pest control, buyers, loan officers, appraisers or insurance agents. In the event of an emergency, Landlord reserves the right to enter Premises without notice.
Assignment
This Lease shall not be assigned by TENANT and no part of the Property shall be let or sublet without the written consent of LANDLORD.
Move-Out
Tenant shall give a written notice with the intent to vacate 30 (thirty) days prior to the date of expiration of the Lease Contract. This notice shall include a new forwarding address. Tenant shall submit their official notice to vacate through the ResidentPortal app
Release From Lease Contract Early Termination
During the initial term of the Agreement, Tenant(s) shall have the option to terminate the remaining responsibility for rent due for the balance of the lease term by providing Landlord with written notice of not less than thirty (30) days together with payment of an early termination fee equal to THREE (3) MONTHS RENT.
Contract Termination and Dispute
This Lease Contract may only be amended, waived, or terminated by our representatives in writing. Any oral promises, representations or agreements by our representatives shall not be considered legally binding.
Rules and Regulations
Mail and packages of any kind are not to be delivered outside of active lease dates. We are not responsible for handling, facilitating or forwarding such mail and/or deliveries
