human rights act HRA 1998
aimed to state rights and freedoms that everyone is entitled to in the UK
the impact allows individuals to take action against courts or people who are infringing these rights
freedom of info act FOI 2001
aimed to allow the public to access info held by public authorities and scrutinise govt activities
impact- increases transparency and accountability to the public and enables public to understand govt process
equality act 2010
aimed to create protected characteristics to prohibit discrimination
impact- expanded those protected to those of age and disability and raised awareness of equality and rights
rights can be restricted (derogation) e.g:
2020 covid act- increased state power and restricted article 5, to protect public health
rights cant be restricted e.g:
rights can only be limited in times of crisis and they cannot derogate articles 2,3,4 and 7 as they are absolute
individ v collective rights of the state e.g:
2013 vinter v others- a murderer was given a sentance in allignment in accordance with article 3 meaning he could be released
clash of rights
collective bodies can claim rights so those and indivduals clash often
2017 co-ed school- sperated boys and girls from year 5. court said this broke individual rights due to denied interaction
