Can you please state your name and occupation for the court?
My name is Scout Ting and I am a producer and founder of CrystalVision Inc. I have produced several hit series.
What television hit series have you produced and their successes?
I have produced Land-Locked, Garrison, and Legally Pink. Additionally, I was fortunate enough to have won a Golden Globe for Best Producer of a Television Series.
How did you become aware of Burr and decide to get involved with it?
I had seen on social media where it was being discussed. After reviewing the play, I immediately recognized its potential as a television series. I believe I could reach a wider audience for the play and thought it would be a great opportunity to bring it onto the screen.
And after deciding to pursue this project, did you possibly reach out to anyone specifically to get involved?
Yes I did, I contacted the playwrights, Hollie Wood and Hunter Hemmingway. I had wanted to meet with them to discuss the possibility of adapting Burr into a television series, and I had felt it was important to speak directly with them to understand their standings on this idea.
Where did you arrange to meet with Hollie and Hunter to discuss this potential project?
We arranged to meet at a coffee shop in Porcupine, Michigan. Given the nature of the meeting and the fact that I was traveling a long way from LA, I thought a neutral setting would be ideal for a productive conversation
During this meeting could you describe the atmosphere and interactions?
From the very beginning, I had noticed Hunter Hemmingway seemed visibly upset.
Can you describe what you mean by he was upset?
His tone was harsh and confrontational from the moment I met him. Which was strange considering we were just discussing a potential partnership. His behavior escalated and he abruptly yelled "Enough!" and stormed out of the coffee shop.
After this interaction how would you characterize Hunter Hemmingway?
Well throughout the meeting Hunter was blunt and dismissive. He claimed that if we were to adapt Burr into a television series, it would feel as if he were "selling his soul". He appeared frustrated with the whole interaction, and unwilling to engage in any real conversation.
After Mr. Hemingway abruptly left the meeting, did you have any further contact communication with him regarding this project?
Yes, on June 3rd, 2023, I received an unsolicited email from Hunter Hemmingway. This was after he had left the meeting in a dramatic fashion, and it was rather unexpected for him to reach out. Along with on July 17th, 2023 also.
If these emails from Mr. Hemingway were to be presented to you, would you recognize it and be able to answer a few questions on it?
Absolutely, I would recognize the email if it were shown to me. It was a direct follow
Who are these emails between?
Hunter Hemmingway and I.
Could you describe the content of the emails exchanged between you and Hunter?
Hunter hemingway had reachout to me stating he is now ready to move forward with the project discussion and that Hollie is the problem.
Could you please read the fifth and sixth lines of Mr. Hemmingways email dated July 17th 2023?
certainly. The email reads " Let me assure you that I will take care of Hollie, so that you need not worry."
Is there anything in this email that concerns you?
The phase "I will take care of Hollie" raised an uneasy feeling as if it was a threat towards Ms. Wood and it was an unsettling comment, and I wasn't sure what he meant by it. It didn't sound too reassuring. It was uneasy and uncomfortable. The way it was phrased gave off a sense of something odd.
Now can you please read the first sentence from line 6 of the email from Mr. Hemingway dated June 3rd, 2023?
The first sentence reads " Hollie is the problem"
After July 14th, 2023 did you receive any further communication from the playwrights or Mr. Hemingway?
Yes I did receive an invitation from them to attend the live performance of burr on opening night. However I could not make it, so instead I attended the dress rehearsal.
Now If i present you with a diagram of the theater with markings where everyone was during the dress rehearsal would you be able to address any questions within this diagram and where you were
Yes I would be able to, I am aware of this diagram and where I was during the dress rehearsal
Where were you seated during the dress rehearsal?
I was seated in the 5th row in the center, it provides the best view of the stage.
Could you please point out where that is?
Yes of course, (Placement letter "B")
While you were seated here what did you see?
During the most popularly known scene where guns were involved, I had seen Hunter Hemmingway with the gun, point it at Hollie wood, and pull the trigger which then the gun being loaded takes Hollies life.
