First Amendment
The amendment that prohibits Congress from making laws that regulate religion, speech, press, assembly, and petition.
Freedom of Expression
A term that encompasses freedom of speech, freedom of press, the right to peaceably assemble, and petition the government.
Political Speech
A form of speech that is protected by the Supreme Court, essential for democracy and accountability.
Expressive Conduct
Also known as symbolic speech, this includes actions that express opinions or messages, such as protests.
Content-Based Regulation
Laws that discriminate based on the subject matter of speech and are subject to strict scrutiny.
Viewpoint Discrimination
A form of content discrimination, deemed especially egregious, where regulation is based on the perspective of the message.
Texas v. Johnson (1984)
A Supreme Court case that ruled that burning the American flag as a form of symbolic speech is protected under the First Amendment.
Compelled Speech
When the government requires individuals to express ideas or beliefs they do not agree with, violating First Amendment rights.
Tinker v. Des Moines (1969)
A Supreme Court ruling that established students do not lose their First Amendment rights at school, particularly concerning political speech.
Symbolic Speech
A type of speech that combines action and expression, such as protests and demonstrations, protected under First Amendment rights.
