Fines

  • This is the most common type of sentence handed out by the Magistrates court.

  • Maximum Mags can give out is 5K to an individual unless it’s a category 5 offence which carry unlimited fines.

Discharges

  • this is where the defendant is convicted of an offence but the court thinks punishment is unnecessary. There are two types: conditional and absolute.

Absolute discharge

  • Defendant is convicted but no penalty is imposed at all. This is likely to be used where a defendant is technically guilty but not blameworthy.

  • For example: going through a red light, but in order to let an ambulance through.

  • Defendant is convicted but discharges him on the condition that no further offences are committed up to three years.

  • If he re-offends the court can exchange this for another offence.
