Fines
This is the most common type of sentence handed out by the Magistrates court.
Maximum Mags can give out is 5K to an individual unless it’s a category 5 offence which carry unlimited fines.
Discharges
this is where the defendant is convicted of an offence but the court thinks punishment is unnecessary. There are two types: conditional and absolute.
Absolute discharge
Defendant is convicted but no penalty is imposed at all. This is likely to be used where a defendant is technically guilty but not blameworthy.
For example: going through a red light, but in order to let an ambulance through.
Conditional discharge
Defendant is convicted but discharges him on the condition that no further offences are committed up to three years.
If he re-offends the court can exchange this for another offence.
