SECTION 1 - Declaration of Policy and Objectives

The State acknowledges the crucial role of children and youth in nation-building and commits to fostering their holistic well-being. The Act aims to:

Strengthen existing mental health programs in schools.

Establish Care Centers in all public and private basic education institutions.

Create Mental Health and Well-Being Offices in every Schools Division Office (SDO).

Program Development

Under the Section 2 - SCHOOL-BASED MENTAL HEALTH PROGRAM

The DepEd is tasked with enhancing current mental health initiatives by developing a comprehensive School-Based Mental Health Program. This program focuses on promoting mental health awareness, providing support services, and ensuring timely referrals for both learners and school personnel.

Service Delivery

Guidelines will be established to ensure effective delivery of mental health services, considering the unique needs and resources of both public and private schools.

Creation of Offices

Each SDO will house a Mental Health and Well-Being Office responsible for overseeing mental health initiatives and addressing the well-being of learners and DepEd personnel within its jurisdiction.

Leadership

These offices will be led by a Schools Division Counselor, a registered guidance counselor or psychologist, holding a Salary Grade 24 position

To encourage open and honest communication between the learner and Schools Division Counselor, School Counselor, or School Counselor Associates and create a safe and trusting environment for the learners, all communications, in any form, in the context of mental health support services shall be considered privileged and confidential except when:

(a) there is a clear and imminent risk of harm to the learner or others,

(b) there is a legal obligation to disclose information in accordance with law, or

(c) the learner, parent, or legal guardian consents to share specific information with designated individuals.
