What is Affirmative Action
A term used to describe policies that favor groups that have been historically discriminated against
What is De Jure segregation?
Discrimination by law (Jim Crow Laws)
De Factor Segregation?
Segregation that arises from personal choice (ex. White Flight)
What does the SCOTUS say about institutions establishing minority quotas, and which part of the constitution is used as evidence to support their opinion?
Argue it’s unconstitutional as it factors race into admission. It is declared unconstitutional under the Equal Protections clause under the 14th amendment, which the SCOTUS argues that people should be treated as people (merit, qualifications, etc) and not just race-based distinctions.
