Congress may not pass a law that prevents citizens form expressing their opinions, either in speech or in writing. Nevertheless, the Supreme Court has placed some limits on these freedoms. Speech or writing intended to incite violence or used to intentionally slander or libel is not protected. Justice Oliver Wendell Holmes articulated the clear and present danger test, in which the government has the right to interfere in free speech if it poses a threat to others.
