State Authority
Public power exercised by an organ of state or natural or juristic person over another in a subordinate position.
Administrative Action
Conduct of functionaries and institutions when exercising public power or performing a public function in terms of legislation.
Just Administrative Action
Manner in which administrative action must be performed, including acting lawfully and reasonably and following fair procedures.
Control of Administrative Action
Means of correcting or rectifying administrative action that is not just or fair.
Section 33(1) of the Constitution
Requires organs of state or natural or juristic persons to act lawfully, reasonably, and procedurally fairly.
Administrative Law
Part of public law that regulates the activities of organs of state and natural or juristic persons that exercise public powers or perform public functions.
Administrative-Law Relationship
A relationship where one legal subject exercises state authority over another.
General Administrative-Law Relationship
A relationship where legal rules apply to all subjects within a particular group.
Individual Administrative-Law Relationship
A relationship where legal rules apply personally and specifically between the parties.
Organ of State (Section 239 of the Constitution)
Includes any department of state or administration in the national, provincial, or local sphere of government or any other functionary or institution exercising a public power or function.
