- The human rights act is not entrenched which means that parliament can change or repeal it if it wishes
- The lack of a Codified constitution means that all laws which protects rights are vunerable because they can be changed by governments with a big majority
- Governments can and do regularly challenge or threatened human rights e.g. thr anti-terror laws passed in 2001 and 2005 which introduced more extensive stop and search powers and house arrest for terror suspects. Liberty was critical of these measures
- Governments can and donthreaten collective rights e.g. the public order act 2023 which allows police to arrest protestors simply on the suspicion that they may cause 'undue dissorder'
- The fundemental problem is that individual and collective rights can clash e.g. freedom of the press vs personal rights and the right to privacy.
