Federalist 10

Madison saw factions as inevitable due to the nature of man: people will continue to form alliances with people who are most similar to them and they will sometimes work against the public interest. The problem in controlling factions include threatening liberty and giving every citizen the same opinions, the same passoons, and the same interests.

Federalist 51

Limits of the government are assured. Positions of each branch are not appointed by another brance (only judicial b/c it’s permanent). Finacial indepdence is esyablished as salaries for official in each branch are protected (congress can’t lower Pres./Court salaries, but they can raise it; Congress can raise/diminish their salaries) Bicamerial branch is established thus prevented an overpowered legislature. And there is a speration of powers & checks and balances between branches.

Believed states would “dwindle away” as the fed. government would have the power to collect state taxes to fund itself; therefore states would be unable to fund themselves. The judicial branch would deprive state courts of their respective powers and their dignity as state judges. A large republic would result in a large Congress (House of Reps.); therefore a large fed. government could become tyrannical.

Federalist 70

The constitution provides for the “energy of the executive.” Stated that if two people were in the executive, it would slow down actions of the government, weaken authority, and hold one executive in higher regard. Placing responsibility would be difficult and having a council of executives would be liable to abuse. Moreover, one singular, strong executive is necessary.

Federalist 78

The Court has the power of judicial review. However, they are limited as they don’t possess the power of the sword or purse. Judiciary acts as a defensive wall of the Consitution against encroachments (intrusion). It’s better for society to have life tenure for judges because these specific judges have experience and sufficient skill in dealing with the constiutionality of laws.

Federalist 84

Hamilton believed that the Bill of Rights was a danger as defining certain rights vaguely would leave them subject to misinterpretation or violation, where previously no such power had existed. Moreover, some important rights would be left out and therefore endangered. “I answer that the Consitution proposed by the convention contains, as well as the constitution of theirs State, a number of such provisions.” [various provisions in favor of particular privileges and rights].
