Difference between Law and Morality/Ethics

Morality/ethics are not bindings, enforceable and have sanctions( chế tài). They are binding on the conscience(lương tâm) of the members of the society

Certain wrongs in society contravene morality/ethics but not the law (disrespect, failure to provide for parents...) ; also the existence of unjust laws (enforcing slavery or legalizing abortions).

Criminal Law

Focus:

Offences against the state.

Prosecution/Claim:(bên khởi kiện)

The criminal offender is prosecuted by the Public Prosecutor(công tố viên). (Public Prosecutor v defendant ).

Sanction/Remedy:(chế tài/ biện pháp)

Punishments: Fine, death sentence, whipping, imprisonment.

Civil Law

Focus:

Concerned with the right and duties of individuals towards each other.

Prosecution/Claim:

Plaintiff(nguyên đơn)/Claimant v Defendant.

Sanction/Remedy:

Remedy: Damages, injunction, rectification, specific performance.

National Law

domestic law. It refers to the set of laws applied within a nation state. It is different in each country.

International Law

The law that governs relations among nations.

Public Law

Law which governs the relationship between individuals and the state.

Private Law

law that involves suits between private individuals or groups( bồi thường, thu hồi tài sản, cưỡng chế các nghĩa vụ)

Procedural Law

It relates to the enforcements of rights and duties (legal procedures) (thực thi các quyền và nghĩa vụ)
