limited the ability of the Chancellor to make laws since they needed to be passed through the Reichstag, which Hitler didn’t control, or passed by presidential decree

other parties still existed and the Nazis did not have an overall majority in the Reichstag in January 1933, so if other parties worked together they could still outvote the Nazis

Hindenberg was still President and he could remove Hitler as Chancellor at any time, especially since Hindenburg never liked him and only appointed him reluctantly because he thought his allies in the cabinet could keep Hitler under control.
