McCullough v. Maryland (1819)
Congress established the Second National Bank to help control unregulated currency issued by state banks
This action was questioned by the states and Maryland set a precedent that required taxes on all banks that were not licensed by the states, which led to Maryland approving legislation to impose taxes on the Second National Bank
James W. McCullough, who worked at the Baltimore branch of the U.S. Bank, refused to pay his taxes so the state of Maryland filed suit against him
The court decided that the Federal Government had the right and power to set up a Federal Bank and states did not have the power to tax he Federal Government'; John Marshall ruled in favor of the Federal Government and stated “the power to tax involves the power to destroy”
