Delegation
The act of Congress giving power to agencies, but with limits.
APA (Administrative Procedure Act)
Known as the 'Constitution for agencies', it outlines how agencies must operate and how their actions are reviewed by courts.
Intelligible Principle
A clear rule that Congress must provide for agencies to act within their delegated powers.
Adjudication
The process by which an agency decides a case, similar to how a court would.
Due Process
The requirement for a hearing or fair treatment in legal proceedings, which can differ based on the number of people affected.
Rulemaking
The process by which agencies create rules that have the effect of law.
Chevron U.S.A. v. NRDC
A case that established that if a law is unclear, the agency can interpret it as long as the interpretation is reasonable.
Loper Bright Enterprises v. Raimondo
A case stating that courts should not automatically defer to agencies' interpretations of unclear laws.
Formal Adjudication
A trial-like process required by law where evidence and witness testimony are presented.
Informal Adjudication
A simpler process used in most cases without needing a formal hearing.
