Commerce Clause
Grants Congress the power to regulate interstate and foreign commerce. Found in Article 1, Section 8, Clause 3 of the Constitution. Has been interpreted broadly to allow federal regulation of many aspects of the economy.
Necessary and Proper Clause
Also known as the Elastic Clause; found in Article 1, Section 8, Clause 18 of the Constitution. Grants Congress the power to make all laws 'necessary and proper' for carrying out its enumerated powers. Allows Congress to exercise implied powers not explicitly listed in the Constitution.
Supremacy Clause
States that the Constitution and federal laws are the supreme law of the land. Found in Article VI of the Constitution. Federal laws generally take precedence over state laws when there is a conflict.
Establishment Clause
Prohibits the government from establishing a religion. Found in the First Amendment. Interpreted to mean that the government cannot endorse or favor any particular religion.
