Purpose of RA 7170
Legalizes donation of human body parts after death for transplantation, therapy, research, and education
Organ Bank Storage Facility
Facility licensed for storage of human bodies or body parts
Decedent
Deceased individual including stillborn or fetus
Testator
Person who makes a legacy of their body
Donor
Person authorized to donate body of a decedent
Part
Includes organs, tissues, eyes, bones, blood, fluids, and other body parts
Death (Definition)
Irreversible cessation of circulatory and respiratory functions OR all brain functions including brain stem
Criteria for Death Determination
Absence of cardiac and respiratory function OR irreversible brain death confirmed by physicians
Any person 18 years old and of sound mind
Section 3 Who May Execute a Legacy
Legacy (Definition)
Donation of body or parts after death for medical purposes
Section 4 Who May Execute a Donation
Spouse; Son or daughter of legal age; Parent; Brother or sister of legal age; Guardian
Timing of Donation
May be made before or after death
Section 5 Examination of Body
Allows necessary examination to ensure medical acceptability
Autopsy Requirement
Required in medico-legal cases to determine organ viability
Section 6 Legatees or Donees
Hospital/physician; Medical or dental schools; Organ bank facilities; Specific individual
Section 8 Manner of Executing Legacy
By will or document; effective upon death; requires 2 witnesses; may designate physician; does not require delivery before death
Section 9 Manner of Executing Donation
Donation must follow rules of movable property; physician/hospital may authorize if no relatives found within 48 hours
Certification of Death for Donation
Confirmed by 2 physicians not involved in transplant team or authorization
Section 10 Authorized Personnel
Only authorized medical practitioners may remove or transplant organs
