Great Bodily Harm
Behavior that physically counteracts an officers control efforts and creates a risk of bodily harm to the officer, subject, or other persons
Active Resistance
A dispute resolution strategy (REACT) used with non-compliant individuals
Arbitration
Direct actions or conduct that generates bodily harm
Assaultive Behavior
Officers use of time, distance, and relative positioning in combo with PCS to attempt to stabilize a situation and reduce the immediacy of threat posed by an individual
De-escalation
Phrase implying that a reasonably careful person performing similar duties and acting under similar circumstance would act in the same manner
Due regard
A conflict resolution strategy to assist disputants in voluntarily reaching a mutually acceptable decision
Mediation
in some states for civil litigation, it is a failure of a law enforcement officer to conform their conduct to a standard of a reasonable law enforcement officer under the same or similar circumstances
Negligence
The standard by which many actions of a police officer are judged: WHould your actions be judged appropriate by a reasonable person based on the totality of the circumstances and the information known to you at the time
Objectively Reasonable
939.45 - Certain conduct is defensible from prosecution under certain circumstances. The defense of privilege can be claimed : conduct is in defense of persons or property, conduct is good faith, and conduct is a reasonable accomplishment of a lawful arrest
Privilege
Exceptions to the general requirement of a warrant under the 4th amendment search and seizures. Exigent circumstances occur when a law enforcement officer has probable cause and insufficient time to secure a warrant because of fear for life, the destruction of evidence, or suspects flight.
Exigent Circumstance
Probable cause
A set of facts and circumstances that woukld lead a reasonable officer to beleive that a specific crime is being, or has been committed by a specific person.
Specific and Articulable facts that would lead a reasonable officer to suspect that a law violation is about to take place, is taking place, or just took place. You are not exactly sure what is going on, but you want to freeze the situation while you investigate further
Reasonable Suspicion
The taking or detaining of a person by word or action into custody so as to subject his liberty to the actual control and will of the person making the arrest. There must exist the intent to take a person into custody, and a corresponding understanding by the person arrested that he is in “custody”, although no formal declaration of arrest is required.
Arrest
A temporary restriction of a persons freedom by law enforcement to investigate possible criminal activity. It’s different from arrest, which involves taking someone into custody for a longer period of time.
Detention
When law enforcement detains a person in a safe place, such as a government facility or foster home or medical facility, to protect them from a dangerous situation or person, including self-harm.
Protective Custody
The intentional use of a firearm or other instrument that creates a high probability of death or great bodily harm.
Deadly Force Definition
The elimination of all other viable alternatives. Within the DAAT system, you may use deadly force to respond to behavior, but only if no other reasonable option is available. In other words, Deadly force is a last resort. You must be able to articulate that, if possible, you attempted to escalate through other modes and tactics, and that all other options except deadly force were closed
Preclusion
What are the 3 elements of the Imminent Threat Criteria
Intent
Weapon
Delivery System
What are the 3 target requirements
Target Acquisition
Target Identification
Target Isolation
Any behavior that an officer reasonably believes: Has caused or imminently threatens to cause death or great bodily harm to you or another person/s
Subject behavior that justifies law enforcements use of deadly force
Law Enforcement may use force legitimately when it is needed to achieve control in 5 specific situations.
To achieve and maintain control of resistive subjects
To detain persons reasonably suspected of criminal behavior
To make lawful arrests
To defend themselves or others
To prevent escape
4 limitations to an officers legitimate use of force:
The U.S. Constitution
Wisconsin Law
Agency Policy
Officer Training
Under Graham V. Connor the U.S. Supreme Court identified 3 criteria to I.D. if an officers use of force is reasonable. Those Criteria Are:
The severity of the alleged crime at issue
Whether the suspect poses an imminent threat to the safety of officers and / or others
Whether the suspect is actively resisting or attempting to evade arrest by flight
