Qualified Fee Estate
A freehold estate also known as a fee simple defeasible estate, where the estate has a condition attached that can annul the estate.
Defeasible
A term used to indicate that something is capable of being annulled or made void.
Two kinds of qualified fee estates
Fee simple determinable and fee on condition.
Fee Simple Determinable Estate
A type of defeasible fee estate that ends automatically upon the occurrence of a specified event.
Condition runs with the land
An encumbrance that is against the land and not personal to the owner of the land.
Grantor
The person who conveys an interest in property.
Example of fee simple determinable
A grant of land 'so long as the land is used only for religious purposes'.
Automatic reversion
The return of property to the previous owner upon the occurrence of a designated event in a fee simple determinable estate.
