International aviation
involves air transportation that crosses the boundaries of one country and operates between nations
Why is international aviation more complicated than domestic aviation?
Because airlines must deal with different governments, laws, regulations, agreements, foreign airports, customs, immigration, safety requirements, and airspace controlled by different countries
Aviation created the needs for common rules such as:
Airspace, aircraft registration, safety, routes, landing rights, international airports, and passenger and cargo transportation
Paris Convention 1919 (also known as Convention Relating to the Regulation of Aerial Navigation)
Helped to produce a set of basic principles in preparing the Convention and its annexes.
What was the first basic principle from the Paris Convention of 1919?
Established basic principles of air sovereignity
What was the second basic principle from the Paris Convention of 1919?
Prescribed for national registration of aircraft
What was the third basic principle from the Paris Convention of 1919?
Placed restrictions on the movement of Military aircraff
What was the fourth basic principle from the Paris Convention of 1919?
Established basic rules of airworthiness in aircraft
What was the fifth basic principle from the Paris Convention of 1919?
Regulated pilots and others in charge of aircraft
What was the sixth and last basic principle from the Paris Convention of 1919?
Provided for police measures
Pan American Convention on Commercial Aviation (aka. the Havana Convention) — 1928
Recognized the every country had complete and exclusive sovereignity over the airspace above its country and adjacent territorial waters
What are the four key differences between the Paris convention of 1919 and the Havana convention of 1928?
The havana convention had no annexes; all rules were contained in the treaty itself
The havana convention was only applicable to private aircraft, government aircraft were not included
Aircraft regulation was to be done according to the laws of each country.
Pilots were required to demonstrate a knowledge of the regulations of each country in which they flew. This meant they were to know the rules of 20 other countries including their own
Warsaw Convention of 1929
Provides rules of air carrier accident liability in international air transportation. The airline is liable for destruction, loss, death, loss of baggage and goods
Chicago Convention of 1944
Established the foundation for modern internation civil aviation. It addressed issues such as international air navigation, aircraft nationality, international air transportation, aviation safety, and rules for operating internationally
What is the first freedom of the air
The right to fly over another country without landing
What is the second freedom of the air
The right to land in another country for technical reasons, such as refueling, without picking up or dropping off passengers/cargo
What is the third freedom of the air
The right to carry passengers/cargo from the airline’s home country to another country
What is the fourth freedom the air
The right to carry passengers/cargo from another country back to the airlines home country
What is the fifth freedom of the air
The right to carry passengers/cargo between two foreign countries as a part of a service connected to the airline’s home country
Bilateral Agreements
Many countries entering into an agreement
International Air Services Transit Agreement
Covers the first two freedoms of the air
International Air Transport Agreement (Five Freedoms Agreement)
Covers the five freedoms of the air, adding three more freedoms
Bermuda Agreement of 1946
Diplomats from the United States and the United Kingdom meeting in Bermuda to sort out regulatory differences
International Air Transportation Competition of 1979
Established several rules stating that safety is the highest priority, rules of maintenance, market competition, etc.
International Deregulation
Removing the federal government’s control of the aviation industry
International Civil Aviation Organization — (ICAO)
Develops international standards and recommended practices for civil aviation
International Air Transport Association — (IATA)
Represents and supports the aviation industry with standards, cooperation, practices, services, and processes
Airports Council International (ACI)
Represents the interests of airports internationally
