Four features of mag group
Mag-plate, tube, follower, spring
Seven basic fundamentals of shooting
stance, grip, sight alignment, sight picture, breath control, trigger control, follow through
Forcible Felony
Any felony which involves the use or threat of physical force or violence against any person.
Great Bodily Harm
Harm to another by depriving him or her of a member of his or her body, rendering a member of his or her body useless, or by seriously disfiguring his or her body or a member therof.
Excessive Force
Force in excess of what a reasonable police officer would believe as necessary.
Deadly force
The use of force that is likely to cause serious bodily injury or death to another person.
Color of Law
Situations where individuals, who are acting in an official capacity or under the authority of a government agency or office, violate someone’s civil rights. It describes the appearance of legal authority or an apparently legal right that may not actually exist. The term is often used to describe the abuse of power under the guise of state authority, and is therefor illegal.
Tunnel Vision
Hyper focused on what is happening in front of you and not around you.
Objective reasonableness
Established for evaluating excessive force claims. Requires that an officer’s use of force be reasonably balanced.
18 USC 241
According to this statute, if two or more persons conspire to injure any person in anywhere with the intent to interfere with their free exercise or enjoyment of any right or privilege secured to them by the Constitution or laws of the United States, they may face legal consequences.
18 USC 242
Anyone who intentionally deprives a person of their constitutional or protected rights while acting under the authority of law, statute, ordinance, regulation, or custom can be penalized.
Federal Civil Rights Act of 1871
Allows individuals to sue when their federally protected rights are violated, including First Amendment rights, Due Process Clause, and the Equal Protection Clause of the Fourteenth Amendment.
42 USC 1983
Establishes the right to sue any state or federal official who violates an individual’s constitutional or legal rights. Allows individuals to seek legal remedies when their rights are violated.
Who does O.C.G.A. 16-3-21 apply to?
Use of force in defense of self or others. A person is justified in threatening or using force against another if they reasonably believe it’s necessary to defend themselves, a third person, or prevent imminent unlawful force.
Who does O.C.G.A. 17-4-20 apply to?
Outlines the authorization of arrests with and without warrants in Georgia and use of deadly force.
Tennessee v. Garner
Officer shot and killed a suspect fleeing. Law enforcement officers may not use deadly force to prevent the escape of a fleeing suspect unless they have probable cause to believe that the suspect poses a significant threat of death or serious physical injury to the officer or others. Considered to be a violation of an individuals Fourth Amendment rights.
Graham v. Connor
Established the proper measure to determine whether a law enforcement officer’s use of force is excessive. The “objective reasonableness” test under the 4th Amendment.
