General Administrative Law Act (GALA)
The primary legislative framework for Dutch administrative law (known in Dutch as Awb), enacted in 1994, which regulates the preparation, taking, and challenging of administrative orders.
Administrative Authority
An organ of a legal entity established under public law or another person or body invested with public authority, possessing competence to make unilaterally binding decisions (Art. 1:1 par 1 GALA).
'a'-organ
An administrative authority that is an organ of a legal entity established under public law (Art. 1:1 par 1(a) GALA), such as a government minister, burgomaster, or public university.
'b'-organ
An administrative authority that is a person or body established under private law but invested with public authority (Art. 1:1 par 1(b) GALA), possessing a clear public task and power to make one-sided binding decisions.
Order (GALA)
A written decision of an administrative authority constituting a public law act (juridical act), as defined in Art. 1:3 par 1 GALA.
Public Law Act
A legal act performed by an administrative authority with the conscious intention to create public law consequences and alter legal status, rights, or duties.
General Binding Regulation (GBR)
An order of a general nature containing independent written rules that are repeatable across people and cases, from which no deviation is allowed.
Administrative Measure
An order of a general nature that affects general as well as specific situations without an independent legal character, filling in the range of an underlying general binding regulation.
Policy Rule
A general rule established by an administrative authority under Art. 1:3 par 4 GALA for weighing interests, determining facts, or interpreting statutory legislation when exercising discretionary power.
Administrative Decision
An order not of a general nature that creates a right or duty or changes the legal status for a specific person or object.
Rejection of Application
An administrative refusal that, under Art. 1:3 par 2 GALA, is treated as equal to a decision so that the applicant has the legal mechanism to contest it.
Coercive Action (Bestuursdwang)
A reparatory administrative sanction under Art. 5:21 GALA involving an instruction with a threat of physical intervention plus a deadline, where costs of reparation fall on the wrongdoer.
Coercive Penalty Payment (Last onder dwangsom)
A reparatory administrative sanction under Art. 5:31d GALA involving an instruction under the threat of paying a sum of money if non-compliant after a deadline.
Administrative Fine
A punitive administrative sanction under Art. 5:40 par 1 GALA imposing a direct, unconditional obligation to pay a sum of money.
Principles of Good Governance
Codified and uncodified substantive norms (such as the principle of legitimate expectations and administrative equality) that limit the power of administrative authorities during decision-making.
Interested Party
A person whose interest is directly affected by an administrative order, as defined in Art. 1:2 par 1 GALA.
Directly Interested Party
An interested party who is the direct addressee of an administrative order and recipient of the resulting right or duty.
Interested Third Party
A non-addressee whose concern in an administrative decision is own, personal, objective, current, and directly linked via a causal connection.
Notice of Objection Procedure
A preliminary, free-of-charge procedure (Art. 7:1 GALA) where the administrative authority conducts a full judicial and functional reconsideration of its decision before court appeal.
Council of State (Administrative Law Division)
One of the highest administrative courts in the Netherlands that hears final instance administrative law appeals.
Central Appeals Court
The highest Dutch administrative court dealing with social security matters (e.g., Welfare Act) and civil servant law disputes.
Trade and Industry Court
The highest Dutch administrative court dealing with economic law disputes (e.g., Competition Act) and issues concerning trade and sector associations.
