Business Law

Charter of Rights and Freedoms
The constitutional guarantee of fundamental rights and freedoms that limits government action.
Constitution Act, 1982
The act that patriated the BNA Act and introduced the Charter; governs constitutional amendments.
Division of Powers
Allocation of legislative authority between federal and provincial governments.
POGG (Peace, Order, and Good Government) Clause
Federal power to make laws for matters not exclusively assigned to provinces.
Ultra Vires
Acts or laws beyond a government’s constitutional power; outside legal authority.
Bona Fide Occupational Requirement (BFOR)
A genuine job requirement justified as necessary for safety or performance; can permit differential treatment.
Meiorin Test
Three-part test to justify a BFOR: rational connection, good faith belief of necessity, and no accommodation without undue hardship.
Notwithstanding Clause (Section 33)
Allows governments to override certain Charter rights for up to five years.
Section 15 Equality Rights
Charter provision prohibiting discrimination and protecting equal treatment on listed grounds; expanded by case law.
