Exigent Circumstances for Warrantless Entry
Situations where an officer may enter a residence to serve a search warrant without knocking and announcing their authority and purpose, including suspect fleeing, evidence being destroyed, a violent crime occurring, or hot pursuit/movable vehicles.
Arrest Warrant for Third Party Residence
Even with an arrest warrant, a search warrant is needed to enter a third party's residence unless the resident consents or exigent circumstances exist.
Probable Cause for Felony Arrest
An officer may arrest someone if they have probable cause to believe the person has committed, attempted, or is committing a felony.
Probable Cause for Leaving the Scene of an Accident
An officer may arrest someone if they have probable cause to believe the person has violated the provisions of IC 9-26-1-1(1), IC 9-26-1-1(2), IC 9-26-1-2(1), IC 9-26-1-2(2), IC 9-26-1-3, IC 9-26-1-4.
Probable Cause for Operating a Vehicle While Intoxicated
An officer may arrest someone if they have probable cause to believe the person has violated the provisions of IC 9-30-5 (operating a vehicle while intoxicated).
Probable Cause for Committing a Misdemeanor
An officer may arrest someone if they have probable cause to believe the person is committing or attempting to commit a misdemeanor in the officer's presence.
Reports Required when Taking Someone into Custody
Incident report, fingerprint cards, photographs, search of person and search of the transporting vehicle.
Search of Arrested Person
An arrested person shall be searched immediately and relieved of any object that may be used as a weapon or aid to escape or which may be evidence of the crime
Physical Search of a Prisoner
The physical search of the prisoner shall be accomplished by an officer of the same sex as the prisoner
Miranda Rights
Before questioning a suspect or prisoner, they must be read their Miranda Rights to counsel and their right to remain silent.
Indiana Implied Consent
In cases involving intoxicated vehicle operators, the Indiana Implied Consent shall be read to the suspect before a chemical test is administered.
Use of Force Report Required
A written report and Use of Force form must be submitted after any use of force by an officer or when actions could result in injury or claim of injury.
Use of Weaponless Control Techniques Reporting
Using weaponless control techniques with little chance of injury to subdue resisting persons does not require a Use of Force form.
When to notify supervisor and file use of force form and long case report
Safety allows and prior to the end of the officer's shift any time that an officer discharges a firearm (for other than approved reasons), takes action resulting in injury or alleged injury/death, applies force through lethal or less-lethal weapons or applies physical force
