Complainant (Section 2(5))
A consumer; a registered voluntary consumer association; the Central or State Government; the Central Authority; one or more consumers with identical interest; legal heir/representative of a deceased consumer; or parent/legal guardian of a minor consumer.
Consumer (Section 2(7))
Any person who buys goods or hires/avails services for consideration paid, promised, or under deferred payment (including approved users/beneficiaries), excluding those obtaining goods or services for resale or commercial purposes.
Consumer Dispute (Section 2(8))
A dispute where the person against whom a complaint has been made denies or disputes the allegations contained in the complaint.
E-commerce (Section 2(16))
Buying or selling of goods or services, including digital products, over a digital or electronic network.
Electronic Service Provider (Section 2(17))
A person providing technologies or processes enabling a product seller to advertise or sell goods or services to a consumer, including online marketplaces and online auction sites.
Goods (Section 2(21))
Every kind of movable property, including "food" as defined in clause (j) of sub-section (1) of section 3 of the Food Safety and Standards Act, 2006.
Central Consumer Protection Council (Section 3)
An advisory body established by the Central Government, chaired by the Minister of Consumer Affairs in the Central Government, which must meet at least once every year.
State Consumer Protection Council (Section 6)
An advisory council established by the State Government, chaired by the State Minister of Consumer Affairs, with up to ten Central Government nominees, meeting at least twice every year.
District Consumer Protection Council (Section 8)
An advisory council established by the State Government for every district, chaired by the Collector of the district, which must meet at least twice every year.
Central Consumer Protection Authority (Section 10)
An authority established by the Central Government in Delhi to regulate consumer rights violations, consisting of a Chief Commissioner and appointed Commissioners.
Investigation Wing (Section 15)
A specialized wing of the Central Authority headed by a Director General created for conducting inquiries or investigations under the Consumer Protection Act, 2019.
Penalties for Misleading Advertisements (Section 21)
Directions to discontinue/modify advertisements; fine up to ten lakh rupees (up to fifty lakh rupees for subsequent contraventions); and endorser prohibition up to one year (up to three years for subsequent contraventions).
District Consumer Disputes Redressal Commission (Section 28 & 34)
A body established by the State Government consisting of a President and at least 2 members, having pecuniary jurisdiction over goods and services paid as consideration up to fifty lakh rupees.
State Consumer Disputes Redressal Commission (Section 42 & 47)
A body established by the State Government consisting of a President and at least 4 members, having pecuniary jurisdiction where paid consideration exceeds fifty lakh rupees but does not exceed two crore rupees.
National Consumer Disputes Redressal Commission (Section 53 & 58)
A body established by the Central Government at NCR consisting of a President and at least 4 members, having pecuniary jurisdiction where paid consideration exceeds two crore rupees.
Age Limits for National Commission Members (Section 55)
Maximum age specified under CP Act rules is seventy years for the President and sixty-seven years for any other member, with a tenure not exceeding five years.
Limitation Period (Section 69)
A strict period of two years from the date on which the cause of action arose, within which a complaint must be filed before a Consumer Commission.
Enforcement of Orders (Section 71)
Execution of orders passed by any Consumer Commission in the same manner as a court decree under the provisions of Order XXI of the Code of Civil Procedure, 1908.
Penalty for Non-Compliance of Order (Section 72)
Imprisonment between one month and three years, or fine between twenty-five thousand rupees and one lakh rupees, or both, tried summarily with First Class Judicial Magistrate powers.
Consumer Mediation Cell (Section 74)
A cell established by the State Government attached to each District and State Commission, and by the Central Government attached to the National Commission.
