Advance Ruling (BOC)
An official written and binding ruling issued by the Commissioner providing an assessment of origin or customs value treatment prior to an import or export transaction.
Advance Ruling (TC)
An official written decision issued by the Tariff Commission providing the appropriate tariff classification of goods under the AHTN prior to importation or exportation.
Advance Ruling Application Fee (BOC)
A non-refundable fee of P1,500.00 payable at the BOC in-house bank (Land Bank of the Philippines) or via wire transfer for foreign applicants.
Advance Ruling Filing Fee (TC)
A filing fee of P1,000 required upon submitting 3 copies of the application form together with supporting documents and samples if required.
Advance Ruling Application Deadline
An application requirement stating it must be filed at least 90 calendar days before the date of importation (lodgment of goods declaration) or exportation.
Advance Ruling Acknowledgment Period
Electronic acknowledgment within 15 working days by the BOC, or acknowledgment within 10 days by the Tariff Commission.
Time Frame to Issue Advance Ruling (BOC)
Within 30 working days from receipt of application or additional documents or information.
Time Frame to Issue Advance Ruling (TC)
Within 30 days from receipt of application sufficient in form and substance or upon submission of all required additional documents.
Express Withdrawal of Application (BOC)
The withdrawal of a request made at the instance of the applicant at any time before the issuance of a ruling.
Implied Withdrawal of Application (BOC)
Deemed withdrawal occurring when an applicant imports less than 90 days after filing/submission or fails to submit required additional information within the prescribed period.
Validity Period of BOC Advance Ruling
Valid for 3 years from the date of issuance, unless a shorter period is provided in the ruling due to the nature of the application.
Validity Period of Tariff Commission Advance Ruling
Valid for 5 years from the date of issuance unless revoked or modified due to changes in facts or circumstances.
Retroactive Revocation (BOC)
The invalidation or revocation of a ruling effective retroactively upon discovery that the applicant submitted incomplete, incorrect, false, or misleading information.
Prospective Modification of Ruling
An alteration of a ruling applied prospectively in cases of clerical error, changed material facts, excusable neglect/honest mistake, or changes in law.
Advance Ruling Revalidation Deadline
Requirement that requests for revalidation must be submitted at least 90 days before the expiration of the ruling's validity.
BOC Appeal Procedure for Aggrieved Applicant
Filing a motion for reconsideration within 15 days from receipt of ruling, and appealing to the CTA within 30 days from receipt of MR denial.
Tariff Commission Ruling Adverse to Government
Elevated by BOC within 5 days to the Secretary of Finance for automatic review within 15 days; deemed confirmed if no decision is rendered within that period.
Motion for Reconsideration for TC Ruling Adverse to Applicant
Filed within 10 days from receipt of ruling for mistake of fact, excusable negligence, or newly discovered evidence; resolved by TC within 10 days (only 1 MR allowed).
CMTA Recordkeeping Requirement
Mandate for both the requesting person and the BOC to keep all requests and supporting records for not less than 3 years from the date of submission.
Penalties for False Documents in Advance Ruling Application
Rejection of the request and revocation of an advance ruling if already issued, without prejudice to other penalties under CMTA.
Duty of District Collector to Report Rulings (Sec. 1503)
Obligation of a District Collector to notify the Commissioner of decisions on new or unsettled questions and submit an adequate statement of facts involved.
Authority to Administer Oaths and Take Testimony (Sec. 1505)
Authority held by the Commissioner, District Collectors, deputies, and deputized officers for any matter within the jurisdiction of the Bureau.
Customs Service Fees Approval (Sec. 1508)
Requirement that service fees for overtime and other customs services be fixed by the Commissioner and approved by the Secretary of Finance.

Prohibited Interests for Customs Employees (Sec. 1511)
Prohibition against owning vessels/aircraft, acting as agent/consignee, or importing goods for sale into the Philippines.
Informer Cash Reward Percentage (Sec. 1512)
A cash reward equivalent to 20% of actual proceeds from the sale of smuggled/confiscated goods or actual collection of additional revenues.
