PD Form 2310.003

The Domestic Violence/Sexual Assault Victim Resource Form furnished to sexual assault victims that describes basic rights and identifies local resources, services, and 24-hour telephone numbers.

Abuse (CPC § 13700(a))

Intentionally or recklessly causing or attempting to cause bodily injury or placing another person in reasonable apprehension of imminent serious bodily injury to himself, herself, or another.

Child

A person under the age of 18 years.

Child abuse or neglect (CPC § 11165.6)

Physical injury inflicted by other than accidental means upon a child, sexual abuse of a child, the negligent failure of a person to protect a child, willful harming or injuring of a child, endangering of the person or health of a child, and unlawful corporal punishment or injury of a child.

Domestic Violence (CPC § 13700(b))

Abuse committed against an adult or fully emancipated minor who is a spouse, former spouse, cohabitant, former cohabitant, or person with whom the suspect has had or is having a child or has had a dating or engagement relationship.

Dominant Aggressor (CPC § 13701(b))

The person determined to be the most significant, rather than the first aggressor.

Injury

Any physical injury that requires professional medical treatment.

Serious bodily injury

A serious impairment of physical condition, including, but not limited to, the loss of consciousness; concussion; bone fracture; protracted loss or impairment of function of any bodily member or organ; a wound requiring extensive suturing; and serious disfigurement.

Domestic Abuse Response Team (DART)

A team working in collaboration with domestic violence advocates, sexual assault nurse examiners, the Los Angeles County District Attorney's Office, and the Long Beach City Prosecutor's Office to provide a comprehensive approach to investigating domestic violence related crimes.

CARPOS

California Restraining and Protective Order System into which protective and restraining order information is entered by the Records Division per CPC § 13710.

Emergency Protective Order (EPO)

A court order obtained by an officer that must be served on a reasonably located person, provided to the protected person or guardian, and submitted to the Records Division for entry into CARPOS.

166 CPC

Willful disobedience of a court order, including the terms as written of any process or court order or out of state court order, lawfully issued by any court, including orders pending trial.

243(E)(1) CPC

Battery committed against a spouse, a person with whom the defendant is cohabiting, a non-cohabiting former spouse, a person who is the parent of the defendant's child, a former spouse, fiancé/fiancée, or a person with whom the defendant currently has or had a dating or engagement relationship.

273.5 CPC

Corporal injury on a spouse, cohabitant, fiancé/fiancée, person of a previous dating or engagement relationship, mother/father of the offender's child.

273.6 CPC

Knowingly and intentionally violating a domestic violence protective order.

646.9(a) CPC

Stalking.

29825(b) CPC

Owning or possessing a firearm while subject to a protective order, temporary restraining order or injunction.

Sexual Assault Response Team (SART)

A multi-agency response team working with sexual assault nurse examiners, crisis advocates, child abuse advocates, and the District Attorney's Office to investigate sexual assaults.

Violence Against Women Act (VAWA) Exams

Sexual assault forensic medical examinations provided to victims at no expense and without requiring participation or cooperation with law enforcement or the criminal justice system.

Child Abuse Response Team (CART)

A specialized response team mobilized for qualifying physical abuse, sexual abuse, or sensitive child abuse incidents.

Suspected Child Abuse Report (SCAR)

A report generated through the Department of Children and Family Services (DCFS) and cross-reported to law enforcement agencies for investigation of suspected child abuse or neglect.
