ISLAMIC SHARIAH

Shariah

• the way to the watering place or the straight path to be followed

• the teaching and the legal system (law) of Islam that Allah S.WT has legislated for mankind , taken from Quran & Sunnah

1) Al-Hakam al-I’tiqadiyyah

-rules relating to belief such as belief such as belief in Allah

2) Al-Hakam al-Akhlaqiyyah

-which refer the rules relating to morality & ethics

3) Al-Hakam al-Amaliyyah

-rules relating to the saying doing of individuals and their relationship with others

Fiqh

• the knowledge of the detailed practical rules that are derived from the sources of Fiqh (Quran & Sunnah)

Maqasid Shariah

• Maqasid (implies justice , moderation & avoidance of excess)

• Maqasid shariah is the objectives of the Islamic law

Daruriyyat

• the essential things and values that  are absolutely important for an individuals’ survival & spritual well-being  in this world & success in the Hereafter 

i) Hifz al-Din

ii) Hifz al-Nafs

iii) Hifz al-Aql

iv) Hifz al-Nasl

v) Hifza al-Mal

Hajiyyat

• the benefits that remove hardships

• lesser essential for human life compared to daruriyyat

• for the obligatory Ibadah, the Shari’ah grants rukhsas (concession) to remove severity from the worshipper who face difficulty establishing the Azimah

Tahsiniyyat

• things that man desires for the purpose of refinement & perfection at all levels of his life
