What is a Summons?
A summons is an order to appear in court
It is a legal document issued by the court or by an administrative agency of government for various purposes
What is a Plaintiff?
a plaintiff is an individual who initiates a lawsuit by filing a complaint against a person or a business
It also means a person who brings a civil action in the court of law, this is also known as a claimant
Sometimes the plaintiff can be the DPP
What is a Defendant?
A defendant is a person or company who gets a case brought to court of law against them
They may be the person who may have been sued or accused of assault etc
What is a Burden of Proof?
burden of proof is where a person has to prove a particular claim or allegation
It is sometimes called the onus of proof
In criminal cases, it is generally on the prosecution
In civil cases, it is generally used on the plaintiff
What is an Oral Evidence?
Oral Evidence is a spoken evidence given by a witness in court
Usually this is done under an oath
What is Reasonable Force?
Reasonable Force refers to the level of force that is considered appropriate and lawful for a person to use when defending themselves or others, or when preventing a crime
What is a Recreational User?
Recreational User is an entrant who, with or without the occupier's permission or at the occupier's implied invitation, is present on premises without a charge being imposed for the purpose of engaging in a recreational activity
What is a Cross Examination?
The defense has the chance to cross examine any witness that is not called on by them
The cross-examining council can challenge parts of the witness evidence
The purpose of it is to get any information that is beneficial to the cross-examining party, and they can test the truthfulness of the witness
They can also raise doubts in the mind of the jury, about evidence that has be given
