Notary Public
A public officer whose functions include: administering oaths, witnessing signing of documents, attesting to identity of signers, noting protests and taking acknowledgements.
Hawaii Notary
Hawaii Resident, 18 years of age, U.S. Citizen
Appointment and Tenure
Appointed/Commissioned by Attorney General for a term of 4 years.
Official Oath
Hawaii Notary is required to take and subscribe an oath for the faithful execution of his/her duties.
Seal
Must be round, not more than 2.5 inches diameter. Must have an uneven border and have the notary name, commission number, state of Hawaii and the words Notary Public.
Official Signature
Signed Name, Printed Name, Expiration date of Commission.
Commission
Must file copy of commission, impression of seal and official signature with county clerk of your jurisdiction.
Authentication
County clerk verifying notary commission on file.
Bond
1,000 surety bond required. Filed and approved by circuit court judge.
Record Book
Type, time date of act. Title or type, date of doc. or proceeding. Signature, printed name and address of each signer and witness. Other parties to instrument and manner in which signer was identified.
Government Notary
Serves in matters pertaining to gov. No fees or bond.
Duties of Hawaii Notary
Taking acknowledgments, administering oaths, affirmations or affidavits, taking depositions, noting protests.
Oath / Affirmation
Verbal pledge that statements made are true. Oath hand on bible, affirmation not on bible.
Affidavit
A signed statement sworn to by signer before notary or other officer authorized to administer oaths.
Affiant
Person who signs affidavit.
Acknowledgment
A formal declaration before an authorized official by a person who has executed a document that the execution was done by the persons free act and deed.
Information Page
Notary Name, Business Address, commission number, commission exp date, book number, beginning and ending dates of acts in book.
Protest
Formal statement in writing by notary under seal that a certain bill, exchange or promisary note was on a certain day presented for payment for acceptance and that such payment or acceptance was refused.
Civil & Criminal Liability
Willfully and knowingly breaching duties, negligent performance resulting in injury. Extortion, Forgery, Pergery, Subornation.
Extortion
The wresting of anything of value from another by Duress, Menace, Force or Undue exercise of power.
Forgery
Fraudulent making or altering of a writing with intent to decieve another and prejudice him in some right.
Subornation
the willful and corrupt procuring of another to commit perjury.
Perjury
Making a false statement which you do not know or believe to be true in an official proceeding under an oath required or authorized by law.
Date
Must be indicated on Document. Hawaii Permits Notarizing on Sunday and Holidays.
Changes
Changes must be approved by notary and signing parties. Must be initialed by notary and all parties. Cannot be recorded with out notary initial to changes.

Venue
Place of notorial act. EX. State of Hawaii, Cunty of Kauai.
Affidavit
Sworn statement of affiant. "John Doe, being first duly sworn on oath, deposes and says..."
Signature
Signature of affiant.
Jurat
Statement that affiant appeared in person on certain day and took oath and signed affidavit and notary witnessed signature. "Subscribed and sworn to before me on this day....."
Notary Signature
Signature, Printed Name, Expiration date of Commission, Seal.
Acknowledgment
Venue, Date of Act, Body (appeared before me), Names, Verify ID " to me known to be", Voluntary Acknowledgment "Acted on free act and deed" ,Testimonium clause "in witness whereof", Notary seal, signature and commission expiration date.
Testimonium Clause
In witness whereof I have hereunto set my hand and seal.
Certificate
for every acknowledgment or jurat hall have certification. Certification shall have: Printed notary name, signature, stamp identify jurisdiction, identify type of document, number of pages, date of document, date of certificate.
Apositlle
Proving authentic notary seal and signature for out of state or out of country documents.
