Term of court
Composed of 4 week sessions for a total of 13 terms in a year.
Notice of Appearance filing deadline
Required to be filed on or before the first court appearance or no later than 10 days after being appointed or retained.
Individual assignment system
A system where a judge is assigned with a case until the day he dies.
E-memoranda word count threshold
Electronically submitted memoranda of law, affidavits, and affirmations exceeding 4500 words must include navigation aids.
Electronic service confirmation (Initial)
A party served with documents electronically must provide confirmation of service within 24 hours.
E-filing exceptions
Matrimonial actions, election law proceedings, cplr 70 and 78 proceedings, proceedings brought pursuant to mental hygiene law, residential foreclosure actions, and proceedings related to consumer credit transactions.
Paper filing (unassigned case)
The moving party must file papers with the court within 5 days of serving them on the other parties if no judge is assigned.
Preliminary conference (disclosure motion)
The court will set a PC date within 45 days if a motion seeks disclosure or a bill of particulars and a conference has not been held.
Consent of adjournments (motions)
Limited to a maximum of three times for a total of 60 days.
CPLR 2101
The statute that papers filed in civil court must comply with.
RJI (Request for Judicial Intervention)
The filing upon which actions and proceedings shall be randomly assigned to a judge.
Electronic service confirmation (Consent)
When a party agrees to accept electronic service, the serving party must be provided with confirmation within 24 hours of service.
Deemed submission of motion papers
Motion papers are deemed to be submitted on the motion's return date.
PC cancellation criteria
A scheduled PC is cancelled if parties agree in writing to complete disclosure within 12 months for standard cases or 15 months for complex cases.
Action ready for trial/inquest
Deemed ready when a Note of Issue & Certificate of Readiness is filed with proof of service.
Bifurcated trial
A trial where the issues of liability and damages are separated; judges are encouraged to order these.
Pretrial Conference Calendar
The calendar for actions awaiting conference after the note of issue and certificate of readiness have been filed.
Note of Issue filing deadline
Must be filed within 10 days of their service.
Initial permanency hearing
For a child in foster care or with a relative, it must be scheduled within 8 months from the date the child was removed from their home per the first court order.
Judge assignment (first document)
Proceedings are assigned to a judge upon the filing of the first document in the case.
PINS runaway notice
Written notice must be given within 48 hours to the clerk of the court when a PINS runs away from a facility.
PINS runaway notice recipients
The Clerk shall give notice to the Presentment Agency, Law Guardian or privately retained attorney, and Petitioner.
