State Dental Practice Act
Has the primary purpose of protecting the public from incompetent of unethical dental professional. This act outlines the legal requirements for the practice of dentistry in each state
State Board of Dental Examiners
Governing body which administers exams required for licensure and enforcements of statues and regulations
Patient of Record
A patient who has been given a treatment plan by a licensed dentist following an examination
Direct Supervision
A procedure is preformed by a dental assistant on a patient of record following an examination while the dentist is physically within the dental office
General supervision (indirect Supervision)
A procedure is performed by a dental assistant on a patient of record following an examination while the dentist is not physically within the dental office
Respondent Superior
This means that the supervising dentist ultimately responsible for any acts that are carried out by an employee according to the dentist’s instruction
Charting
Keeping accurate and complete records is the best way for a dental team to protect against legal action
Omission
This involves failure to act as a “reasonable prudent professional” would act
Commission
An act that a “reasonable prudent professional” would not perform
Consent
To accept or approve the recommended or preformed treatment
Informed Consent (Written Consent)
When informed consent is given, patient or guardian is given an explanation of the prescribed treatment and is given the opportunity to have any questions answered
Implied Consent
This type of consent is given by the actions of the patient. It is implied that the doctor is working in the patient’s best interest. This type of consent is not recommended
