  • Ex. One becoming nervous and unable to answer simple questions, like ties to community, when questioned by police.

  • Temporary Seizure of an object or person to investigate suspicion or unlawful activity.

  • An example of a Terry stop is when a police officer stops someone in a known drug area for suspicious behavior, like exchanging an item, and has a reasonable belief they may be armed.

What is the scope of Terry Stops

  • Brief: Must act with due diligence to solve suspicion. Is agent making best effort to resolve suspicion w/ least intrusive means?

  • Investigative: Figure out if right or wrong.

  • Inquire: Use the least intrusive means necessary to confirm or dispel suspicion regarding criminal activity.

  • Search warrant: temporarily seizing to prevent flight if incriminating evidence is found

  • ex. Border officers detaining anyone arriving from foreign countries to determine citizenship and admissibility or cops conducting DUI checkpoints to deter drunk or unlicensed driving.
