Republic Act No. 9173

The formal title of the "Philippine Nursing Act of 2002" which provides for a more responsive nursing profession.

Republic Act No. 7164

The law known as "The Philippine Nursing Act of 1991" which was repealed by Republic Act No. 9173.

Professional Regulatory Board of Nursing

The body created to supervise and regulate the practice of the nursing profession, composed of a Chairperson and six (6) members.

Board Member Qualification: Education

A registered nurse and holder of a master's degree in nursing, education or other allied medical profession, provided that the Chairperson and the majority of members hold a master's degree in nursing.

Board Member Qualification: Experience

Must have at least ten (10) years of continuous practice of the profession prior to appointment, with the last five (5) years being in the Philippines.

Term of Office (Board of Nursing)

The Chairperson and members hold office for a term of three (3) years and may be re-appointed for another term.

Subpoena ad testificandum and Subpoena duces tecum

Powers vested in the Board to secure the appearance of respondents and witnesses and the production of documents during investigations.

Licensure Examination Passing Rating

An examinee must obtain a general average of at least $75\%$ with a rating of not below $60\%$ in any subject.

Examination Retake Rule

An examinee who obtains an average of $75\%$ or higher but scores below $60\%$ in any subject must take the examination again only in the subject(s) where they were rated below $60\%$.

Registration by Reciprocity

The issuance of a certificate of registration/professional license without examination to nurses registered under foreign laws, provided the foreign country grants the same privileges to Filipino nurses.

Inactive Nurses Requirement

Nurses who have not actively practiced for five (5) consecutive years must undergo one (1) month of didactic training and three (3) months of practicum.

Nursing Faculty Qualification

Must be a registered nurse in the Philippines with at least one (1) year of clinical practice in a field of specialization and a holder of a master's degree in nursing, education, or allied medical sciences.

Dean of a College of Nursing Qualification

Must have a master's degree in nursing and at least five (5) years of experience in nursing.

Salary Grade 15

The minimum base pay for nurses working in public health institutions as prescribed under Republic Act No. 6758.

Nursing Specialty Program Beneficiaries Service Obligation

Beneficiaries are obliged to serve in any Philippine hospital for a period of at least two (2) years of continuous service.

Penalties for Illegal Practice

A fine of not less than $P50,000.00$ nor more than $P100,000.00$ or imprisonment of not less than one (1) year nor more than six (6) years.

Section 39: Separability Clause

A provision stating that if any part of the Act is declared unconstitutional, the remaining parts shall continue to be valid and operational.

Nursing Service Administrator: Chief Nurse Qualification

Must possess at least five (5) years of experience in a supervisory or managerial position in nursing and a master's degree major in nursing.
