Republic Act No. 8495

Board of Mechanical Engineering

Includes prime movers, steam generators, heat exchangers, materials handling equipment, HVAC systems, and piping systems with a working pressure of not less than $70\,kpa$.

Capacity of process works

The total kilowatt ratings of all engines, motors, boilers, turbines, or other primemovers installed for use, regardless of whether they are in operation.

Passing Rating

To pass the licensure examination, a candidate must obtain an average of $70\%$ on all subjects, with no rating below $50\%$ in any subject.

Piping system pressure threshold

Piping systems included under mechanical equipment or machinery are those with a working pressure of not less than $70\,kpa$.

PME Experience Requirement

To qualify for the Professional Mechanical Engineer examination, a registered mechanical engineer must have a specific record of a total of $4$ years or more of active practice.

Board Member Age Requirement

A member of the Board of Mechanical Engineering must be at least $35$ years of age at the time of their appointment.

Board Member Practice Requirement

A member must be a Professional Mechanical Engineer with a valid license and an active practitioner for not less than $10$ years prior to appointment.

Term of Office

A member of the Board shall hold office for a term of $3$ years and may be reappointed for another $3$ year term, but shall not serve more than two regular terms.

Seal of a Professional Mechanical Engineer

A specialized seal bearing the registrant's name, certificate number, and the legend 'Professional Mechanical Engineer' used to stamp plans, designs, and technical reports.

Personnel requirement for over $2000\,kW$

Every mechanical work project or plant in operation with a capacity over $2000\,kW$ requires at least one professional mechanical engineer per shift.

Personnel requirement for $100\,kW$ to $300\,kW$

Plants in this capacity range require at least one certified plant mechanic, mechanical engineer, or professional mechanical engineer per shift.

Re-examination Rule

An applicant who fails to pass the licensure examination for the third time shall be allowed to take another examination only after the lapse of $1$ year.

RA 8495 Penalties

Violations of the Act result in a fine of not less than $P50,000.00$ nor more than $P200,000.00$, or imprisonment of $6$ months to $3$ years, or both.

Foreign Reciprocity

The provision allowing foreign mechanical engineers to practice in the Philippines only if their home country permits Filipino engineers to practice on the same basis.
