Republic Act (R.A.)

Republic Act No. 5527 (Philippine Medical Technology Act of 1969)
An Act requiring the registration of medical technologists, defining their practice, and providing for related purposes.

Medical Technology (definition)
An auxiliary branch of laboratory medicine dealing with chemical, microscopic, bacteriologic, and other tests aiding diagnosis and health.
Pathologist
A duly registered physician specialized in laboratory medicine who diagnoses disease and interprets tissues and secretions.
Medical Technologist
A person who performs medical technology work under the supervision of a pathologist or licensed physician.
Medical Technician
A non-graduate who performs MT work under supervision, having passed the corresponding civil service examination.
Section 15 – Examination (Registration Exam)
Annual MT examination in Manila area plus Cebu and Davao in August/September; notices published 30 days prior.
Section 17 – Scope of Examination
Examination covers Clinical Chemistry, Microbiology/Parasitology, Hematology, Blood Banking/Serology, Clinical Microscopy, Histopathologic Techniques; weighted by subject.
Section 18 — Report of Rating
The Board shall, within one undred and twenty (120) days after the date of completion of the examination, report the result thereof to the Commissioner of Civil Service, who shall submit such result to the President of the Philippines for approval
Section 19 – Ratings in the Examination
To pass: general average of 75% with no subject below 50% in major areas; must pass at least 60% of subjects.
Section 21 – Issuance of Certificate of Registration
Certificate issued to those who pass; minimum age 21; certificate signed by Board members.
Section 24 — Administrative Investigation
Administrative investigations shall be conducted by at least two members of the Board with one legal officer sitting during the investigation. The existing rules of evidence shall be observed during all administrative proceedings, the respondents shall be entitled to be represented by counsel or be heard in person, to have a speedy and public hearing to confront and cross-examine witnesses against him or her, and to all other rights guaranteed by the Constitution.
Section 25 — Appeal
The revocation or suspension of a certificate made by the Board shall be subiect to appeal to the Civil Service Commissioner whose decision shall become final thirty days after its promulgation, unless the respondent within the same period has appealed to the office of the President of the Philippines.
Section 22 – Fees
Fees for examination and registration (e.g., 50 pesos for exam/registration; additional fees for replacement certificates and related costs).
Section 26 — Reinstatement, Reissue, or Replace of Certificates
The Board may, upon application and for reason deemed proper and sufficient, reissue any revoked registration certificate.
Section 27 — Foreign Reciprocity
No foreigner may practice or be examined unless the country of which they are a citizen permits Filipino MTs to practice on the same basis.
Section 28 – Roster of Medical Technologists
Annual public roster listing names, addresses, citizenship, and registration status of MTs.
Section 29 – Penal Provision
Penalties for illegal practice, practicing without supervision, falsifying reports, or misusing certificates; includes fines and possible imprisonment.
Section 30 - Separability clause
If any provision of this Act or the application of such provision to any person or circumstance is declared invalid by a court of competent jurisdiction, the remainder of this Act or of the application of such provision to other persons or circumstances shall not be affected by such declaration.
Section 31 – Repealing Clause
Repeals inconsistent acts, rules, and orders, while preserving certain preexisting medical acts (e.g., Medical Act of 1959, Clin Lab Act, Blood Banking Law).
