Under RULE 701, Mr. Farnsworth is a lay witness that can give rationally based perceptions (he has sold alcohol 9 YEARS, and can tell who is under the influence or not.
Farnsworth Crossed: Opposing council asks about Jacob and the little red truck
Under RULE 802, This is hearsay, that employee is not here to testify and Mr. Farnsworth cannot answer to what Jacob said.
Farnsworth Crossed: Opposing council asks ANYTHING about the Mercado Shooting.
Under RULE 401, The incident opposing council is trying to bring up, THE MERCADO INCIDENT, does not have a tendency to make Mr Farnsworth liability more or less probable and therefore not relevant. The incident does not involve alcohol, nor the sale of it, nor any witness other than Mr. Farnsworth, and is not admissable.
