What happened?
Through judiciary act of 1801, midnight jusges were created by john adams and filled by federalist judges (demo-rep mad bc federalists given too much power)
One of the judges appointed, marbury, did not receive his commission and he sued madison (the person who should have given him his commission)
Court (led by chief justice John Marshall) said, yes he should have got his commission, but the supreme court could do nothing about it because the supreme court did not have the right to original juristiction

The fact that this occurred so early in supreme court hitory sets up success as a power in the federal government
