Republic Act No. 11036

The official act known as the "Mental Health Act," established to create a national mental health policy and enhance integrated mental health services.

Addiction

A primary chronic relapsing disease of brain reward, motivation, memory, and related circuitry, leading to biological, psychological, social, and spiritual manifestations.

Carer

A person, who may or may not be the patient's next-of-kin, who maintains a close personal relationship and manifests concern for the patient's welfare.

Confidentiality

Ensuring that all relevant information regarding psychiatric, neurologic, and psychological health needs is kept safe from unauthorized access, use, or disclosure.

Deinstitutionalization

The process of transitioning service users from institutional settings to community-based settings to enable social participation and recovery-based approaches.

Discrimination

Any distinction, exclusion, or restriction that nullifies the recognition, enjoyment, or exercise of human rights and fundamental freedoms on an equal basis.

Drug Rehabilitation

Processes of medical or psychotherapeutic treatment for dependency on psychoactive substances like alcohol and drugs, or behavioral addictions like gambling.

Impairment or Temporary Loss of Decision-Making Capacity

A medically-determined inability of a service user to provide informed consent, as assessed by a mental health professional based on understanding and communication.

Informed Consent

Consent voluntarily given to a treatment plan after full disclosure in plain language regarding the nature, consequences, benefits, risks, and alternatives of the treatment.

Legal Representative

A person designated by the service user, appointed by a court, or authorized by law to act on the service user's behalf, including via an advance directive.

Mental Health

A state of well-being where an individual realizes their abilities, copes with normal stresses, works productively, and contributes to the community.

Mental Health Condition

A neurologic or psychiatric condition with a clinically-significant disturbance in cognition, emotional regulation, or behavior reflecting underlying dysfunction.

Mental Health Facility

Any establishment or unit of an establishment whose primary function is the provision of mental health services.

Mental Health Professional

A medical doctor, psychologist, nurse, social worker, or appropriately-trained person with specific skills relevant to mental health services.

Mental Health Service Provider

An entity or individual, public or private, providing mental health services, including professionals, workers, advocates, and nonmedical therapy providers.

Mental Health Service

Activities and programs including promotion, prevention, treatment, and aftercare provided by facilities and professionals across the mental health spectrum.

Mental Health Worker

A trained person, volunteer, or advocate engaged in mental health promotion and support services under the supervision of a mental health professional.

Psychiatric or Neurologic Emergency

A condition presenting a serious and immediate threat to the health and well-being of a service user or others, requiring immediate medical intervention.

Psychosocial Problems

Conditions indicating dysfunctions in behavior, thoughts, and feelings caused by sudden, extreme, prolonged, or cumulative stressors.

Recovery-Based Approach

Intervention and treatment centered on service user strengths, involving participation of persons with lived experiences as equal partners in care.

Service User

A person with lived experience of any mental health condition, including those undergoing psychiatric, neurologic, or psychosocial care.

Support

Formal or informal arrangements, such as community services or peer support, aimed at assisting a service user in exercising legal capacity or rights.

Supported Decision Making

The act of assisting a service user, who is not affected by impairment of capacity, in expressing a mental health-related preference or decision.

Republic Act No. 7277

Known as the "Magna Carta for Disabled Persons," its applicability to persons with mental health conditions is expressly recognized under the Mental Health Act.

Advance Directive

A signed, dated, and notarized document where a service user sets out their preferences in relation to treatment.

Internal Review Board

A board mandated in health facilities to review cases, disputes, and controversies involving service user treatment, restraint, or confinement.

Philippine Council for Mental Health

A policy-making, planning, and advisory body attached to the DOH to oversee the implementation of the Mental Health Act.

Section 44 Penalty Clause

Prescribes imprisonment of 6 months to 2 years and/or a fine of 10,000 to 200,000 pesos for violations like failure to secure informed consent or breach of confidentiality.
