General Order 61.2.5
Establishes guidelines and procedures for crashes involving Valparaiso Police Department vehicles and a Crash Review Process.
Officer's Initial Actions After a Crash
If an officer is involved in a crash, they should briefly evaluate the scene, check for injuries and hazards, and notify the on-duty Supervisor or officer in charge.
Portable Breath Test
The operator of the department vehicle shall submit to this test while on scene of the crash.
Investigating Officer's Responsibility
Responsible for submitting the completed crash report, statements, diagrams, and photographs to the Captain of Patrol immediately upon completion of the investigation.
Members of the Valparaiso Police Department Crash Review Board
Assistant Chief, Captain of the division, Accident Reconstructionist, E.V.O.C. Instructor, and an Officer chosen by the affected Officer of the same rank.
Ten (10) days
The officer(s) involved in the crash must be notified in writing at least this many days prior to the crash review date.
Thirty (30) days
The Crash Review Board must meet within this many days after the crash to conduct a review.
Defensive Driving
The Board determines whether the crash was non-preventable or preventable based on this concept.
Chief of Police
The Crash Review Board reports all findings to this person within three (3) days upon completion of the review, who has the discretion to accept, reject, or modify the findings.
Five (5) days
The officer has this many days to appeal the decision of the Board and/or Chief of Police's decisions.
Twelve (12) month period
If three (3) or more preventable crashes occur withing this time period, he/she may be referred to the Chief of Police for a possible hearing before the City Board of Works for possible suspension, demotion, or dismissal.
Crash Review Board Meetings
Meetings are executive sessions and considered internal investigations, not subject to the Open Door/Open Records Law.
Two (2) points
For every preventable crash, the officer gets this many points.
One (1)
Minimum number of contributing circumstances that must be assessed for each preventable crash.
Written Warning or Written Reprimand
Consequences for officer if points total between 1 to 7 points.
Alcoholic Beverages
A contributing circumstance where points range from 5 to 20 points.
Up to and including termination
Additional disciplinary action(s) for points totaling 21 and Above.
